Not So Fast!

An Hispanic American Supreme Court Justice, if selected by President Obama to replace departing Justice David Souter, would not, as previously reported, be a first. That honor belongs to Justice Benjamin Cardozo, who sat from 1932 to 1938.

As The Volokh Conspiracy notes, Justice Cardozo’s ancestors trace their line to the Iberian Peninsula; by strict Federal law, this makes Cardozo Hispanic (49 U.S.C. Section 26.5 describes Hispanics as “persons of Spanish or Portuguese culture or origin, regardless of race”).
